your letter No. 17 of the 28th. February forwarding a despatch from the Tut relative to the extradition of Chung Hsiu-nan.

This Government has already explained the position

of affairs to the Wai Chiao Pu through His Majesty's Minister

at Peking. It is provided under Article 21 of the Treaty of Tientsin that if criminals, subjects of China, shall take refuge in Hongkong, they shall upon due requisition by the Chinese Authorities be searched for and on proof of their guilt be deliver- -ed up. The question of a criminal's guilt is in the first instance considered by the Police Hagistrate, who commits the accused to prison, there to await the Governor's order, if it appears to him to be probable that the man has committed the offence with which he is charged. But the decision of the Police Magistrate as to proof of guilt is not final, and the accused has the right of appeal on this point, first to the Full Court of Hongkong, and again from that Court to the Privy Council; and the Governor cannot take action until the question is finally settled. In the present case the Full Court has upheld the decision of the Police Magistrate that the accused should be delivered over to the Chinese Authorities, but it is understood that he proposes to

carry the matter to une Privy Council.

I shall be glad if the Tutu may be informed that the procedure observed in extradition matters is not peculiar to Honkong, but that it obtains throuhout the British Empire and applies to the subjects of all Powers with whom extradition

treaties have been arranged.
